Welcome to Viato Notary. These Terms & Conditions govern your use of our website, scheduling systems, and notarial services. By accessing or using our services, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use immediately.
Viato Notary is the assumed business name (DBA) of Viato Ventures LLC, a Texas Limited Liability Company.
Throughout this document, the terms “Viato Notary,” “we,” “us,” and “our” refer collectively to Viato Ventures LLC dba Viato Notary.
1. Notary Scope of Services
Our notaries perform authorized notarial acts in accordance with Texas law, including:
- Verifying signer identity
- Witnessing signatures
- Administering oaths/affirmations
- Completing acknowledgments and jurats
Notaries cannot:
- Explain document contents
- Provide legal advice
- Recommend whether to sign
- Assist in completing documents
- Draft legal language
Doing so constitutes the unauthorized practice of law.
If you require legal guidance, consult a licensed attorney.
2. Authorized Identification
You must present valid, unexpired, government-issued photo identification. Accepted IDs include:
- U.S. driver’s license or ID card
- U.S. passport
- Military ID
- Foreign passport (valid)
Failure to provide proper ID will result in service denial and possible travel/service fees.
RON (Remote Online Notarization) sessions may also require:
- Credential analysis
- Knowledge-based authentication (KBA) questions
3. Remote Online Notarization Requirements
By booking a remote appointment, you agree to:
- Appear on camera
- Allow session recording
- Complete identity verification
- Allow digital credential checks
Recordings may be retained as required by Texas law.
4. Refusal of Service
We reserve the right to refuse service if:
- Signer is unwilling or unable to provide valid ID
- Signer appears coerced or unaware
- Document contains blank spaces
- The notarial act is improper or illegal
- Fraud is suspected
Travel/service fees may still apply.
5. Appointment Policies
Late Arrivals
We allow a 15-minute grace period for all appointments. After this window, a late fee of $1 per minute will apply, or the appointment may be rescheduled with applicable return fees.
No-Shows
A no-show may result in forfeiture of the booking fee or full invoice charge at our discretion.
Cancellation
Mobile appointments canceled within 24 hours of scheduled time may incur a cancellation fee based on travel distance and time reserved.
6. Travel & Mobile Fees
Mobile notarization includes:
- Travel to your location
- Waiting/parking considerations
- Time-based convenience
Travel fees are due regardless of whether notarization can be completed if:
- ID is invalid
- Document is incomplete
- Signer is absent
7. Document Preparation
Clients are responsible for:
- Preparing documents prior to the appointment
- Completing all non-notarial fields
- Ensuring proper notarial certificates are provided
If a certificate is missing, we may provide compliant options, but cannot choose, interpret, or recommend them.
8. Payments
We accept:
- Cash
- Major credit/debit cards with a 3% processing fee applied per transaction
- Digital payment platforms: Zelle, Venmo Business, Square, Paypal, Cash App
For General Notary Work (GNW), full payment is required prior to the scheduled appointment to secure the time slot and avoid no-shows. If payment is not received, the appointment may be canceled or rescheduled at our discretion.
For loan signing assignments, invoicing and payment terms may be arranged with contracting companies, signing services, or title/escrow partners in accordance with industry standards and agreed-upon fee schedules. Invoices not paid within 7 days of the due date may incur late fees. Chargebacks or payment disputes will be contested with supporting documentation, including signed journal entries, digital logs, or session recordings when applicable.
Travel fees are non-refundable once the notary has departed for the appointment location.
Remote Online Notarization sessions will not begin until payment is confirmed.
9. Recordkeeping
Texas law may require retention of:
- Notarial journal entries
- Remote session recordings
- Digital evidence of identity verification
We adhere to statutory retention periods.
10. Accuracy of Information
You agree to provide accurate information during:
- Scheduling
- Identity verification
- Document execution
False representation may constitute fraud.
11. Limitation of Liability
Viato Notary and Viato Ventures LLC are not liable for:
- Legal outcomes of your document
- Rejection of documents by third parties
- Errors in documents not prepared by us
- Delays beyond our control
Our liability is limited to the amount paid for services rendered.
12. Website Usage
This website and its content are provided for general informational purposes. We make no guarantees regarding:
- Accuracy
- Availability
- Fitness for a particular purpose
We may modify content at any time without notice.
13. Intellectual Property
All content, branding, text, and imagery on this website are the property of Viato Ventures LLC dba Viato Notary and may not be reproduced without written consent.
14. Privacy
Our collection and use of personal data are governed by our Privacy Policy, located in the footer of this website.
By using our services, you consent to lawful data collection and retention.
15. Third-Party Services
Remote notarization platforms and scheduling systems may be provided by third parties. We are not responsible for:
- Outages
- Data breaches
- Platform errors
- Login issues
Your use of those platforms is subject to their policies.
16. Governing Law
These Terms & Conditions are governed by the laws of the State of Texas.
Any legal disputes shall be resolved in the courts of Travis County, Texas.
17. Amendments
We may update these Terms & Conditions at any time. Changes take effect when posted to this page.
Your continued use of our website or services after revisions constitutes acceptance.
